BestRateUAE — Terms and Conditions

Important Notice

BestRateUAE is a digital marketplace. It lets you explore information about financial products made available by participating financial institutions in the United Arab Emirates and, if you choose, connect with one of them. BestRateUAE does not itself provide, arrange, finance, advise on or approve any financial product, and does not make credit or eligibility decisions. Each participating financial institution is solely responsible for its own products, eligibility criteria, assessments, approvals, pricing, fees and contractual terms. If you proceed with a financial product, you should read and understand the terms given to you directly by that institution, and seek independent advice if you are in any doubt.

1. About BestRateUAE and These Terms

1.1 These Terms and Conditions (“Terms”) govern your access to and use of the BestRateUAE website — including any version of our website that you install on your device (for example, by adding it to your home screen) — and related marketplace services (together, the “Platform”). The Platform is operated by BestRate Company FZCO (“BestRate”, “BestRateUAE”, “we”, “us” or “our”).

1.2 Please read these Terms carefully. By accessing or using the Platform, you agree to be bound by them. If you do not agree, you must not use the Platform.

1.3 Capitalised terms used in these Terms have the meaning given in Section 21 (Definitions), unless defined elsewhere in these Terms.

1.4 We may update these Terms from time to time, at our discretion, to reflect changes in our Services, our business or applicable law. Where a change is material, we will give you reasonable prior notice (for example, by notice on the Platform or by email) before it takes effect. Your continued use of the Platform after a change takes effect means you accept the updated Terms. We recommend you review this page periodically.

2. Nature of the Platform

2.1 BestRateUAE operates as a digital marketplace and comparison platform. The Platform enables you to explore information about financial products made available by Participating Institutions and, where the relevant functionality is available, to request to connect with a Participating Institution you select.

2.2 BestRate is licensed by the Dubai Multi Commodities Centre Authority (DMCC) under the commercial licence activity “E-Marketplace Service Provider.” BestRate is not a bank, financial institution, lender, deposit-taker, credit broker or financial adviser.

2.3 BestRateUAE does not itself provide, offer, issue, fund or finance loans, credit cards, deposits or any other financial product. We do not make credit, eligibility, approval or rejection decisions, and we do not determine any Participating Institution’s rates, fees, limits or other product terms. We do not receive, hold, transfer or disburse customer funds.

2.4 Each Participating Institution acts independently of BestRateUAE and is solely responsible for its own products, eligibility criteria, “know-your-customer” and assessment processes, approvals and rejections, pricing, fees, disclosures, contractual terms, customer servicing and regulatory obligations.

3. Marketplace Enquiries and Connections

3.1 You may use the Platform to explore product information and, if you choose, to submit an enquiry or request to connect with a Participating Institution regarding a product displayed on the Platform.

3.2 Where you request or authorise a connection, we may transmit the information you have provided to the relevant Participating Institution so that it can respond to your enquiry, in accordance with our Privacy Policy and applicable law.

3.3 Submitting an enquiry, or receiving a response, acknowledgement or indicative message through the Platform, does not constitute approval, pre-approval, a binding offer or a financial-product agreement of any kind. Only the relevant Participating Institution can decide whether to contact you, request further information, assess your eligibility, or offer you a product, and it will do so under its own process and timeline.

4. Product Information

4.1 Information about financial products displayed on the Platform is provided for general product discovery and comparison purposes. It may be supplied by Participating Institutions or from other sources, and it may change without notice.

4.2 We use reasonable efforts to present information clearly and keep it current, but we do not guarantee that product information on the Platform is complete, accurate, or current at any given time, or that it is suitable for your particular circumstances. Before relying on any product information, or entering into any agreement, you should confirm the current terms directly with the relevant Participating Institution.

5. No Financial, Investment or Credit Advice

5.1 BestRateUAE does not provide financial, investment, legal, tax or credit advice. Nothing on the Platform — including product listings, comparison features, filters, calculators or any communication from our Customer Support Team — is or should be treated as a recommendation, or as a determination that a particular product is suitable for you.

5.2 You are solely responsible for deciding which products or Participating Institutions to explore, whether to submit an enquiry, and whether to enter into any agreement with a Participating Institution. If you are in any doubt about the suitability of a product, you should seek independent professional advice.

6. Calculators and Illustrative Tools

6.1 Any calculator or estimation tool on the Platform is provided for general illustrative purposes only. Results are mathematical estimates based on the figures you enter (and, where stated, on assumed rates), and do not reflect any specific Participating Institution’s actual pricing.

6.2 Calculator results are not a quotation, financial offer, approval, eligibility assessment, or recommendation, and must not be relied upon as such. Actual rates, fees, eligibility and repayment or return amounts are determined solely by the relevant Participating Institution.

7. Registration and Account Security

7.1 Certain features of the Platform may require you to register and create an account (“User Account”). To register, you may be asked to provide your name, contact details and, where applicable, confirm your mobile number by one-time password (OTP).

7.2 You agree that the information you provide when registering, or at any other time, is true, current and complete, and you will update it if it changes. You may access your User Account to review or update your details.

7.3 You are responsible for keeping your User Account credentials confidential and secure, and for all activity that takes place through your User Account. You must notify us promptly at the contact details in Section 19 if you believe your User Account has been accessed without your authorisation, or if your credentials have been lost, stolen or compromised.

7.4 You may not create more than one User Account, and you may not transfer, assign or share your User Account with anyone else.

7.5 We may suspend or terminate a User Account, or refuse to create one, where we reasonably believe information provided is false, inaccurate or incomplete, where we suspect misuse, fraud or a breach of these Terms, or as described in Section 15 (Term and Termination).

8. Fees

8.1 BestRateUAE does not charge users any fee to browse, compare or use the marketplace functionality of the Platform.

8.2 We may receive a commission, referral fee or other commercial payment from a Participating Institution in connection with a connection, enquiry or referral made through the Platform. Receiving such a payment does not change our role: we remain a marketplace operator and do not act as agent for, or on behalf of, you or the Participating Institution in respect of the underlying financial product.

9. Communications

9.1 By using the Platform, you agree that we (and our service providers acting on our behalf) may contact you by telephone, SMS, email, push notification, or other methods you provide to us, for purposes connected with the Services — including responding to an enquiry, providing customer support, or (where you have separately consented) sending you marketing communications.

9.2 It is your responsibility to keep your contact details up to date and to notify us promptly of any change.

10. Acceptable Use

You agree that you will not, in connection with the Platform:

use the Platform for any unlawful purpose, or in a way that could damage, disable, overburden or impair the Platform or any third party’s enjoyment of it;

attempt to gain unauthorised access to the Platform, any User Account that is not yours, or any system or network connected to the Platform;

introduce any virus, malware or other harmful code to the Platform;

scrape, harvest or extract data from the Platform other than through functionality we provide for that purpose;

impersonate any person or entity, or misrepresent your affiliation with any person or entity; or

infringe our intellectual property rights or those of any third party.

11. Intellectual Property

11.1 The Platform, and all content, design, software, trademarks and other materials made available on it (together, “Content”), are owned by or licensed to BestRate and are protected by applicable intellectual property laws.

11.2 Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Platform for your personal, non-commercial use. You must not copy, reproduce, distribute, modify, publicly display, create derivative works from, or otherwise commercially exploit the Platform or the Content, except as we expressly permit or as permitted by applicable law.

12. Third-Party Providers and Links

12.1 The Platform may display information about, or link to, Participating Institutions and other third parties. Those organisations are independent of BestRateUAE, and we do not control, and are not responsible for, their products, websites, content, privacy practices or contractual terms.

12.2 A listing, link, or marketplace connection on the Platform does not mean that BestRateUAE endorses, guarantees, or is a party to, any third party’s product or service.

13. Disclaimers

13.1 To the maximum extent permitted by applicable law, the Platform and all information on it are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.

13.2 We do not guarantee that any Participating Institution will contact you, respond to your enquiry, approve any request, or offer you any particular product, rate or term. We do not guarantee that the Platform will be available, uninterrupted, secure, or free of errors.

13.3 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable UAE law, including liability for fraud or wilful misconduct.

14. Limitation of Liability

14.1 Subject to Section 13.3, to the maximum extent permitted by applicable law, BestRate will not be liable to you for any indirect, incidental, special or consequential loss or damage arising out of or in connection with your use of, or inability to use, the Platform, or your reliance on any product information made available on it.

14.2 You acknowledge that BestRate is not a party to, and has no liability in connection with, any agreement you may enter into with a Participating Institution.

15. Term and Termination

15.1 These Terms take effect when you first access or use the Platform and continue until terminated in accordance with this Section.

15.2 You may stop using the Platform, and request closure of your User Account, at any time by contacting us at the details in Section 19.

15.3 We may suspend or terminate your access to the Platform or your User Account, with notice to the email address registered with us, if you breach these Terms, if we reasonably suspect misuse, fraud or unlawful activity, or for operational, security or legal reasons. Where reasonably practicable, we will give you advance notice.

15.4 Sections of these Terms which by their nature should survive termination (including Sections 5, 11, 13, 14, 16 and 20) will continue to apply after termination.

16. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold BestRate harmless against any claims, losses, liabilities and reasonable costs (including legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any applicable law or third-party right, except to the extent caused by our negligence or wilful default.

17. Assignment and Force Majeure

17.1 We may transfer or assign our rights and obligations under these Terms to another entity (for example, in connection with a corporate reorganisation), provided this does not materially reduce your rights under these Terms. You may not assign or transfer these Terms, or any rights under them, without our prior written consent.

17.2 We will not be liable for any failure or delay in performing our obligations under these Terms where this is caused by events beyond our reasonable control, including natural disasters, government action, war, civil unrest, labour disputes, power or telecommunications failures, or cyberattacks.

18. Complaints

If you have a concern or complaint about the Platform or the Services, please contact our Customer Support Team using the details in Section 19. We aim to acknowledge complaints promptly and work with you to resolve them.

20. Governing Law, Jurisdiction and General

20.1 Governing law. These Terms are governed by the laws of the United Arab Emirates applicable in the Emirate of Dubai.

20.2 Jurisdiction. Subject to any mandatory dispute-resolution requirement under applicable law, the courts of Dubai have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Platform.

20.3 Electronic contracting. Your acceptance of these Terms, including by continuing to access or use the Platform, constitutes a valid electronic acceptance for the purposes of UAE Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services (as amended or replaced from time to time).

20.4 Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

20.5 Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and BestRate in relation to your use of the Platform, and supersede any prior agreement or understanding on that subject.

21. Definitions

Participating Institution means a bank, financial institution or other provider that has been onboarded to the Platform to display or offer its products and/or services.

Platform means the BestRateUAE website — including any version of our website that you install on your device (for example, by adding it to your home screen) — and related marketplace services, together.

Privacy Policy means the BestRateUAE Privacy Policy published on the Platform, which is incorporated into these Terms by reference.

Services means the marketplace and related functionality described in Section 2, as may be amended, expanded or reduced by us from time to time.

User Account means the account you create on the Platform in accordance with Section 7.

Website means the website at www.bestrateuae.com (or such other domain as we may notify to you from time to time).
